Terms of Service

1. Eligibility
You must be at least 18 years old to use the Service. By using Commit, you represent that you are 18 or older, that you have the legal capacity to enter into a binding agreement, and that you are authorized to use the payment method you provide. The Service is not directed to anyone under 18, and we do not knowingly allow them to use it.
2. What Commit Is
Commit is an accountability tool. You set a personal daily step goal and a daily stake between $1 and $10. The app reads your step count from Apple HealthKit to determine whether you met your goal each day. For each day you genuinely miss your goal — your step count is below your goal and the reading is complete — one day's stake is forfeited. Days with missing or unreadable step data, sanctioned rest days, and days you place on a planned pause are never charged. If you meet your goal every day of a commitment, you are charged nothing.
The amount you forfeit is a real-money accountability fee, not a purchase of digital goods or services, and not a wager. Commit is not gambling: there is no prize pool, no element of chance, and no winnings. The outcome is fully within your control — meeting your daily step goal results in no charge. Forfeited amounts are retained by Nicholas Hughes.
3. Payment Authorization
When you create a commitment, you save a payment method using Stripe via a SetupIntent. By doing so, you authorize us to place authorization holds on that payment method and to capture from them off-session, without further action from you, to cover days you genuinely miss. Commit divides your commitment into short billing windows (up to six days). For each window it places one authorization hold sized to that window's maximum stake, then — once the window has passed — captures only the amount for the days you genuinely missed; if you missed nothing in that window, the hold is released and no money moves. Your total forfeit can never exceed your daily stake multiplied by the length of your commitment.
We use Stripe to process payments. We do not store your full card number; the app stores only a payment-method token returned by Stripe. Your authorization remains in effect until your active commitments end and you delete your account. See the Forfeit & Refund Policy for details on charges, declines, and disputes.
4. Commitments and Cancellation
A commitment runs from its start date to its deadline. You may cancel an active commitment at any time from within the app; when you do, any open authorization hold is released and you are not charged for any day after the cancellation. Days you genuinely missed before cancelling are still settled. A commitment otherwise ends when it reaches its deadline, at which point any remaining settlement is completed and the commitment is closed. You may keep one active commitment at a time. Deleting your account does not waive amounts already owed for days you genuinely missed before deletion.
5. Account Deletion
You may sign out at any time. You may also delete your account from within the app's Settings. Deleting your account removes your profile and associated data as described in our Privacy Policy, subject to our need to retain certain records to complete or evidence charges already incurred and to meet legal, accounting, and fraud-prevention obligations.
6. Acceptable Use
You agree not to:
- Use the Service if you are under 18 or otherwise ineligible.
- Provide false information or use a payment method you are not authorized to use.
- Attempt to falsify, spoof, or manipulate step data, HealthKit readings, or check-in results.
- Interfere with, disrupt, reverse-engineer, or attempt to gain unauthorized access to the Service or its systems.
- Use the Service for any unlawful purpose.
7. Health Disclaimer
Commit is not a medical or fitness service and provides no medical advice. Step goals are personal targets you set. Consult a qualified professional before beginning any physical activity program. You are solely responsible for setting goals appropriate to your health and abilities.
8. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that step data, HealthKit integration, or charges will always be accurate or timely.
9. Limitation of Liability
To the maximum extent permitted by law, Nicholas Hughes and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of the Service. To the maximum extent permitted by law, our total aggregate liability for any claim relating to the Service will not exceed the total amount you forfeited through the Service in the three (3) months preceding the event giving rise to the claim.
10. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the effective date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
11. Governing Law
These Terms are governed by the laws of the State of Tennessee, USA, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the courts located in the State of Tennessee, USA for any dispute that is not otherwise subject to an applicable arbitration or alternative-resolution provision.
